Effective date: September 16, 2026
These Terms of Service (“Terms”) are an agreement between you and Jorge, an individual Texas sole proprietor operating Capper (“Capper,” “we,” “us,” or “our”). By purchasing, downloading, installing, accessing, or using Capper, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use Capper.
Eligibility and U.S. availability
You must be at least 18 years old, legally capable of entering a contract, and located in the United States. Capper is offered only to users in the United States. You may not use Capper if doing so would violate applicable law or sanctions.
Software license and activation
Subject to these Terms and an active local trial or payment of applicable charges, Capper grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the macOS app for your own lawful purposes. A license may be activated on up to three Macs, subject to the product configured in Polar. A Mac must be deactivated before its activation slot can be reused or the stored key can be replaced.
A one-time Capper License enables Local mode. An active Capper Cloud subscription enables both Local and Cloud modes. A one-time purchase does not promise perpetual maintenance, compatibility, support, or new features. We may provide signed automatic updates through Sparkle.
Except where law allows otherwise, you may not sell, sublicense, transfer, rent, or share a license; bypass activation or usage limits; interfere with security; introduce malicious code; use the service to attack or probe systems; or reverse engineer Capper except to the limited extent a non-waivable law permits it.
Local trial
The 14-day local trial requires no account and starts with the first local request after setup, not download, installation, or opening onboarding. Reinstalling or reopening onboarding does not restart it. After expiry, new local requests require a valid paid license; work already in progress is not interrupted. Existing buyers retain full local access. The local trial does not grant a Cloud subscription or Cloud credits.
Your content and model output
You retain any rights you have in instructions and content you submit. You grant Capper and its service providers a limited right to process that content only as needed to provide, secure, and troubleshoot the request. You represent that you have the rights and authorization needed to submit it.
To the extent permitted by law, Capper does not claim ownership of model output generated for you. Output may not be unique, and other users may receive similar output. You are responsible for reviewing output, determining whether it is accurate and appropriate, and making any decision to copy, insert, publish, or rely on it.
AI limitations and prohibited high-risk use
Capper uses generative AI, which can be incomplete, inaccurate, offensive, outdated, or unsuitable. Capper is a writing tool, not a substitute for qualified professional judgment. Do not use Capper to make consequential decisions about another person involving health, law, employment, housing, credit, education, insurance, eligibility, public benefits, or safety.
You may not use Capper for unlawful, deceptive, infringing, abusive, discriminatory, or harmful activity; to create or distribute malware; to violate another person's privacy or rights; or to process protected health information, payment-card data, government identifiers, or other regulated data without a separate written agreement that expressly permits it. No such regulated-data agreement is currently offered.
Local models and custom servers
With On this Mac selected, rewriting and dictation run inside Capper. Setup downloads need an internet connection. Purchased-license validation and optional update checks also use the internet.
Loopback Local presets send requests to a model server on your Mac and do not use Capper Cloud. If you configure a non-loopback Custom server, you direct Capper to send captured content to that server. You are responsible for its operation, security, models, terms, and data practices.
Capper Cloud and credits
Cloud is closed to new subscriptions. Existing subscriptions keep their current service, pricing, and benefits, and continue renewing until canceled. This change does not cancel a subscription or remove access already purchased.
Cloud text requests pass through Capper, OpenRouter, and a selected zero-data-retention model provider. Availability, latency, and model behavior may vary. We may replace the underlying model while preserving the advertised Fast-model service category.
Every completed Cloud request consumes at least one credit. Larger instructions or captured selections may consume additional credits based on request size. A request stopped after its first response token consumes its reserved credits; an upstream failure or cancellation before the first token does not. The service stops when the remaining balance cannot cover a request and does not create an overage charge. Credits reset each monthly benefit cycle, do not roll over, have no cash value, and cannot be transferred.
Payments, subscriptions, cancellation, and refunds
Polar is the merchant of record and authorized reseller. Polar handles checkout, payment processing, applicable sales taxes, receipts, and subscription administration under its buyer terms. Prices are shown in U.S. dollars unless checkout states otherwise.
Cloud subscriptions renew automatically each month at the disclosed price until canceled. You authorize recurring charges when you subscribe. You may cancel online at any time through the Polar customer portal linked from your purchase email or Capper Settings. Cancellation takes effect at the end of the current paid billing period unless law requires otherwise.
Except where required by law, all purchases and subscription charges are final and non-refundable. This rule does not limit any non-waivable consumer right, remedy, or refund required by applicable law. Contact support promptly if a product was not delivered or you believe a charge is incorrect.
Privacy and third-party services
The Privacy Policy explains Capper's data practices. Apple, local model hosts, custom servers, Polar, OpenRouter, model providers, GitHub, Vercel, Neon, Upstash, and Sparkle may have their own terms and policies. Capper does not control user-selected custom servers or locally installed models. Third-party services may change, become unavailable, or experience outages.
Capper ownership and feedback
Capper and its licensors own the app, website, service, branding, documentation, and related intellectual property, excluding your content and rights expressly granted under open-source licenses. If you voluntarily provide feedback, you permit us to use it without restriction or compensation, without identifying you publicly without permission.
Service changes, suspension, and termination
We may update, modify, suspend, or discontinue features to maintain security, comply with law, respond to provider changes, or improve the service. We may suspend or terminate access for fraud, chargebacks, security threats, unlawful conduct, material breach of these Terms, or requirements imposed by law or a provider. Where practical, we will provide notice and an opportunity to cure. You may stop using Capper at any time; deleting the app does not cancel a Cloud subscription.
Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPPER IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR ERROR-FREE OPERATION. WE DO NOT WARRANT ANY AI OUTPUT, LOCAL MODEL, CUSTOM SERVER, OR THIRD-PARTY SERVICE. SOME LAWS DO NOT ALLOW CERTAIN DISCLAIMERS, SO THEY APPLY ONLY TO THE EXTENT PERMITTED.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPPER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION. CAPPER'S TOTAL LIABILITY ARISING FROM OR RELATING TO THE PRODUCT OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID FOR CAPPER DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. NON-WAIVABLE LIABILITY AND CONSUMER RIGHTS ARE NOT EXCLUDED.
Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, except where a non-waivable law requires otherwise. Before filing a claim, you and Capper agree to try in good faith for 30 days to resolve it by emailing the other party. These Terms do not require arbitration and do not waive a right to participate in a class action.
Changes, severability, and contact
We may update these Terms prospectively. We will post the revised Terms with a new effective date and provide additional notice when required. Material subscription changes apply as required by law. If part of these Terms is unenforceable, the remaining terms remain in effect. Our failure to enforce a term is not a waiver. These Terms and the documents they incorporate are the entire agreement about Capper unless you and Capper sign a separate written agreement.
